Update on Article 15.03 Arbitration

On May 8, 2019 the first arbitration hearing on Union grievances bearing nos. 20160615Ai, 20160615B, 20160615Bi and 20161009, concerning article 15.03, took place at 688 Sherbrooke West, Montreal. Me Serge Brault presided over the arbitration. Union was represented by Me Kateri-Helene Racine whereas, the employer was represented by Me Marie Cousineau. This arbitration concerns non-posting of several courses from Fall 2016 and Winter 2017 semesters, allocation of courses to outsiders calling them professionals, using course lecturers as professionals defeating the purpose of the seniority list that was established months before the grievances were filed. It was unfortunate that the Union had to resort to grievance procedure the very first semester when the Collective Agreement was enforced. The Union in good faith, made every effort to resolve the issue on table through negotiation but all in vein. The employer did not agree on any solutions that were suggested by the Union, hence forcing the process to arbitration.

Notice to affected parties

As per article 100.5 of Quebec Labour Code please be advised that the next arbitration hearing on these Union grievances is scheduled for July 24, 2019 at 688 Sherbrooke West, on the 15th floor, from 9:00 am – 5:00 pm. Those who are affected by this arbitration and are interested in being represented and attending are welcome to come.
